In compliance with the provisions of article 10 of Law 34/2002, of July 11, on Services of the Society of Information and Electronic Commerce, we inform you of the following:

- STATIM LEGAL, S.L.P. (hereinafter, STATIM) is a company dedicated to providing legal advisory services.

- STATIM is registered in the Commercial Registry of Barcelona, volume 48398, sheet 149, page B-582640.

- STATIM, with NIF B-10904449, is a company domiciled at 08021 Barcelona, Avenida Diagonal 624, 2º2ª and is the owner and entity responsible for the commercial use, management and operation of the website www.statim.es (hereinafter, the Website). Our contact email address is info@statim.es.

Users

Access and/or use of the Web grants the condition of user of the same (hereinafter, the User) who accepts, from said access and/or use, the terms of use described in this Legal Notice (hereinafter, the Terms of Use) without reservation. Therefore, it is recommended that the User carefully read the Terms of Use each time they wish to access and use the Website, since these Terms of Use may be modified. All Website Users can print or save these Terms of Use in electronic format.

The Terms of Use will apply to all Website Users, regardless of whether they are private or professional Users.

Use of the Website

The Website provides access to a multitude of information, services and/or data (hereinafter, "the Contents"), belonging to STATIM or third parties. The User assumes all responsibility for any use made of the Website, which extends and includes, but is not limited to, mere browsing, access, use and download of Content.

Neither the Contents nor any element of the Website constitute, nor can or should be interpreted as, legal or juridical advice of any kind, nor can they in any way substitute proper legal advice. Access to the Website and its Contents does not imply the establishment of a service provider relationship between the User and STATIM, nor does it imply acceptance by STATIM of any professional assignment. The Web and its Contents are merely informative, and the User must take into account that such Contents may not reflect an updated situation of the matter they deal with from a legislative and/or jurisprudential point of view.

The User undertakes to make correct, lawful and adequate use of the Website and the Contents and must refrain from carrying out any illegal, incorrect, inappropriate action or activity, contrary to good faith, morality, good customs, fundamental rights and public liberties and/or public order or that in any other way is detrimental to the Website and/or STATIM, and in particular will refrain from and will not carry out any of the conducts, actions and activities listed below (list is merely for illustrative purposes and not exhaustive):

- Cause damage to the physical and logical systems belonging to STATIM, its suppliers or any other third parties, introduce or spread computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage and any others.Access and/or use email accounts and/or STATIM data.

- Employing, including, linking and/or in any way using the Website and/or any of its Contents and elements on other websites and/or applications and/or physical or electronic media of any kind, without our prior express authorization and written.

- Create or in any way establish a link, hyperlink or link to any content on the Web, whatever the purpose thereof.

- Carry out any act that implies a disclosure of secrets, violation of confidentiality obligations or infringement of the regulations for the protection of personal data.

- Use the website for an illegal purpose or for any purpose not expressly authorized by STATIM.

Likewise, the User may not introduce, display, use or incorporate any of the Contents included in the Website as their own business activity or that of third parties, let alone dispose of them. The use or application of any technical, logical, or technological resources by virtue of which Users may benefit, directly or indirectly, with or without profit, from the unauthorized exploitation of the Web or any of its Contents is also expressly prohibited.

Intellectual and Industrial Property

All distinctive signs, trademarks, trade names, content, structure, images, videos, design, software, source code, form of presentation of the elements, and any other information that appears on the Website are owned by STATIM (by itself or as assignee or licensee) and are protected by industrial property rights Identification data. Any use that the User makes of the Website in no case and in no way confers any right of any kind, including a license, on any of such signs and elements.

The User is prohibited from copying, sharing, extracting, reproducing, transforming, distributing, public communication and, in general, any other form of exploitation of the elements referred to in the previous section and of any of the elements or Contents of the Website, regardless of whichever automated or manual means or process used, without STATIM’s prior, express and written authorization, as well as the performance of any act that may imply an infringement of the industrial and intellectual property rights belonging to STATIM or to third parties.

The User will refrain from using means that can delete, alter, evade, or manipulate any protection devices or security systems that may be installed and that entail a risk or damage or possibility of disabling the Website and/or its Contents.

STATIM is not responsible for any possible inappropriate use that third parties make of the Website, nor is it responsible for the information that they transmit to third parties through them. Any use of the Contents that the User may make and the eventual consequences, damages or losses that may arise, are the sole responsibility of the User. STATIM declines any responsibility for damages of any nature caused to Users through the use of links, directories and search tools, which allow Users to access websites belonging to and/or managed by third parties, as well as due to the presence of viruses or other malicious codes that may cause any type of damage to a computer system, electronic documents or files belonging to Users or third parties.

STATIM reserves the right to exercise any and all legal actions it deems appropriate in case of non-compliance with any of the above provisions.

Exclusions from guarantees and responsibility

STATIM has adopted the measures that, within its possibilities and in accordance with the current state of technology, allow the proper functioning of the Website, as well as the absence of viruses and harmful components. However, despite the security measures adopted, STATIM cannot guarantee the absence of viruses or other elements that could damage or alter the User's computer system, nor does it assume any responsibility derived from it.

In no case shall STATIM be held responsible for damages of any kind that may be caused, among others, by: (i) the misuse or improper use of the Website and/or its Contents by its Users; (ii) the lack of continuity and availability of the Website Content as well as the delays or failures that occur in accessing them; (iii) the presence of viruses and/or other harmful components on the Website and/or on the servers; (iv) the accuracy and/or updating of the Contents, texts, links or any other elements incorporated into the Website; (v) the contents and/or services provided by other webpages to which the User may have access from the Website; (vi) unauthorized access and alteration of the data stored and transmitted through the Website and (vii) the breach of security systems hosted and/or inserted through the Website.

STATIM is also not responsible for damages of any kind produced to the User that are caused by failures or disconnections in the telecommunications networks and that may cause the suspension, cancellation and/or interruption of the Web service.

Likewise, STATIM is not responsible for any damages that any User may cause, either to him or herself or to third parties, in violation of the conditions, rules and instructions that STATIM establishes on the Website. Consequently, the User will be liable for all damages of any nature that STATIM or any third party may suffer as a result of breaching any of the obligations to which they are subjected by these Terms of Use.

In the event the User detects technical incidents in the Website’s operation or detects errors or inaccuracies in any of its elements or Contents, they may notify us at the email address info@statim.es. 

Modifications and interruption or suspension of access to the Website

STATIM reserves the right to carry out the modifications it deems appropriate on the Web without prior notice, and is able to change, delete or add to both the contents and services provided through it and/or the way in which they appear and/or where they are located on the Website.

At the same time, STATIM reserves the right to suspend or interrupt, temporarily and without prior notice, access to the Website due to maintenance, repairs, updates or improvements, as well as due to power supply errors or any other cause.

Links

In the event that links or hyperlinks to other Internet sites are available on the Website, STATIM will not exercise any type of control over said sites and content. In no case will STATIM assume any responsibility for the contents of any link belonging to a third-party website or App, nor will it guarantee the technical availability, quality, reliability, accuracy, breadth, veracity, validity and/or constitutionality of any material or information contained in any of the aforesaid hyperlinks or other Internet sites or Apps. Likewise, the inclusion of these external connections will not imply any type of association, merger, or participation between STATIM and the connected entities.

Miscellaneous

STATIM reserves the right to deny, restrict or withdraw access to the Website and/or the Contents without prior notice, on its own or by request of a third party, to those Users who fail to comply with any of these Terms of Use, without the right to compensation or indemnity of any kind.

STATIM reserves the right to exercise any and all rights and actions it deems appropriate, including of a criminal nature, in case of violation, infringement or breach of these Terms of Use or of any legal provision by the Users.

STATIM complies and will comply with the obligations set forth in terms of personal data protection in current regulations and will at all times ensure that it may guarantee the correct use and treatment of any personal data collected from the User, in accordance with the Privacy Policy also available on the Website, which we invite you to consult at any time.

Through the Website, you can access STATIM's social networks with open access to all Users. These are websites or applications where the User can register and follow us for free. In these social networks, Users will be able to learn about our activities, opinions, or access photos, videos, or other multimedia content. The Users of these social networks must be aware that the STATIM profiles in such networks are independent from the website www.statim.es and are public since they are visible to all its Users, and the privacy policies and terms of use that apply to these contents are those set by the corresponding social network.

Modification to the Terms of Use

STATIM may modify the Terms of Use determined herein at any time and without prior notice and proceed to publish the new ones on the Website, without this granting the right to compensation or indemnification of any kind to the Users. When the User accesses the Website after a modification to the Terms of Use, they will be expressly accepting the new Terms. If you do not agree with any of these modified Terms, you must immediately stop using the Website. If you continue accessing and/or using the Website, it will be understood that you are accepting the new Terms.

Applicable Law and Jurisdiction

These Terms of Use and Legal Notice are subject to Spanish Law. All issues, conflicts, discrepancies and/or controversies that may arise from the interpretation, application, compliance, breach, validity and/or execution of these Terms of Use and Legal Notice will be submitted to the jurisdiction and competence of the Courts and Tribunals of the city of Barcelona, expressly waiving any other general or specific jurisdiction or that could correspond to the parties.
